Terms of Service

1. Introduction & Acceptance of Terms

Welcome to loamholm.com, operated by LOAMHOLM, LLC. These Terms of Service govern your access to and use of our website, product pages, customer account features, checkout process, payment services, order fulfillment, and other services made available through our online store.

By accessing loamholm.com, creating an account, placing an order, or otherwise using our website, you agree to be bound by these Terms of Service together with the policies referenced throughout this website.

If you do not agree with these terms, you should not use our website or submit an order.

2. Eligibility to Use Our Website

You may use our website and place an order only if you are legally capable of entering into a binding transaction under the laws applicable to you.

By submitting an order through loamholm.com, you confirm that the information you provide is accurate, complete, and current, and that you are authorized to use the payment method submitted during checkout.

If you use our website on behalf of a company, organization, or other legal entity, you represent that you have authority to accept these Terms of Service on behalf of that entity.

3. Website Use & Customer Accounts

You agree to use loamholm.com only for lawful purposes and in a way that does not interfere with the operation, security, availability, or integrity of our website.

You must not attempt to gain unauthorized access to customer accounts, administrative systems, checkout functions, databases, payment interfaces, or other restricted areas of the website.

If you create a customer account, you are responsible for maintaining the confidentiality of your login credentials and for activity carried out through that account.

If you believe that your account has been accessed without authorization, please contact LOAMHOLM, LLC promptly.

4. Product Information, Appearance & Natural Variations

We make reasonable efforts to present product descriptions, photographs, dimensions, capacities, colors, finishes, materials, and other product information accurately.

However, the appearance of tableware may vary slightly from photographs because of lighting, photography, screen settings, production methods, material characteristics, or normal manufacturing variation.

Ceramic, porcelain, stoneware, glass, wood, metal, and other materials may show subtle differences in color, glaze, texture, pattern, tone, surface detail, shape, or finish between individual pieces.

Such differences may form part of the character of the material or production process and do not necessarily indicate that the product is defective.

Customers should review the individual product page for the most relevant information concerning dimensions, capacity, material, finish, quantity, care instructions, and other product-specific details before purchasing.

5. Product Availability

Products displayed on loamholm.com are subject to availability. The presence of a product on our website does not guarantee that it will remain available indefinitely.

We may add, remove, discontinue, replace, restrict, or update products and collections at any time where reasonably necessary.

If a product becomes unavailable after an order has been submitted, we may contact you and provide an appropriate resolution, which may include cancellation of the affected item and a refund where applicable.

6. Prices, Currency & Pricing Errors

Product prices are displayed in the currency indicated through our website or checkout. Unless otherwise stated, transactions completed through loamholm.com are processed in United States Dollars (USD).

If your payment account uses another currency, your card issuer, bank, or payment provider may convert the transaction using its own exchange rate and may charge additional conversion or international transaction fees.

We make reasonable efforts to maintain accurate pricing. However, typographical, technical, or display errors may occasionally occur.

If a material pricing error affects an order that has already been submitted, we may contact you before fulfillment and provide the option to proceed at the corrected price or cancel the affected item or order.

7. Orders & Order Acceptance

Submitting an order through loamholm.com does not automatically mean that the order has been finally accepted for fulfillment.

Orders may be subject to payment authorization, fraud screening, inventory confirmation, address verification, product availability, and other operational checks before shipment preparation begins.

We may refuse, hold, or cancel an order where reasonably necessary, including circumstances involving suspected fraud, unauthorized payment activity, product unavailability, material pricing errors, shipping restrictions, duplicate orders, or material violation of these Terms of Service.

If an order is cancelled after payment has been successfully collected, any applicable refund will be handled according to the relevant payment and refund procedures.

8. Payment Terms

Payment must be successfully authorized before an order can proceed to fulfillment.

Depending on the payment option selected at checkout, payments may be processed through third-party payment providers including Stripe and PayPal.

For more information regarding accepted payment methods, transaction currency, payment authorization, payment security, failed transactions, refunds to the original payment method, and payment disputes, please refer to our Payment Policy.

9. Shipping & Delivery

We provide worldwide shipping to eligible destinations according to the rates, delivery estimates, and other conditions described in our Shipping Policy.

Worldwide Standard Shipping is charged at a fixed rate of $4.99 USD per order. We do not currently offer free shipping or order-value-based free-shipping thresholds.

Because our store may offer ceramic, porcelain, stoneware, glass, and other fragile tableware, orders may require protective packaging intended to reduce movement and impact during normal transportation.

After order processing and dispatch, Standard Shipping is estimated to take approximately 30 calendar days. Actual delivery time may vary depending on the destination address, carrier operations, customs processing, weather, public holidays, regional restrictions, transportation interruptions, or other circumstances outside our reasonable control.

Expedited shipping may be available depending on the destination and available carrier services. Additional expedited shipping charges may vary according to the delivery location, parcel characteristics, and selected service and must be confirmed before the expedited service is arranged.

For complete information regarding shipping fees, processing times, estimated delivery periods, expedited shipping, carriers, tracking, fragile-item packaging, transportation damage, customs duties, and delivery issues, please refer to our Shipping Policy.

10. Returns & Refunds

Eligible products may be returned according to the return period, product-condition requirements, return procedures, and other conditions set out in our Refund & Returns Policy.

Customers should inspect tableware before use. Products that have been materially used, washed, damaged, stained, chipped, cracked, scratched, altered, or otherwise changed after delivery may not qualify for a standard change-of-mind return where permitted by applicable law.

For complete information regarding return eligibility, the 30-day return period, return shipping responsibilities, damaged or incorrect products, inspection procedures, refund processing times, and refunds to the original payment method, please refer to our Refund & Returns Policy.

11. Product Use, Care & Customer Responsibility

Customers are responsible for reviewing any care, cleaning, handling, storage, temperature, or usage instructions supplied with a product or stated on the applicable product page.

Different tableware materials may require different forms of care. Products should not automatically be assumed to be dishwasher-safe, microwave-safe, oven-safe, freezer-safe, or suitable for direct heat unless the applicable product information expressly states that such use is appropriate.

Damage caused by misuse, accidental impact, dropping, inappropriate cleaning products, abrasive materials, extreme temperature changes, improper storage, use outside the intended purpose, or failure to follow applicable care instructions may not be considered a product defect.

Customers are responsible for determining whether a particular product is appropriate for their intended use based on the product information provided.

12. Dimensions, Capacity & Product Selection

Customers should carefully review the dimensions, capacity, quantity, material, finish, and other specifications displayed on the relevant product page before placing an order.

Measurements may be rounded or subject to small tolerances associated with manufacturing methods and the nature of individual materials.

Where tableware is intended to coordinate with existing pieces, customers are responsible for checking relevant dimensions, proportions, colors, and other specifications before purchase.

A difference caused solely by incorrect product selection does not automatically mean that a product is defective where the relevant product information was reasonably disclosed before purchase.

13. Fragile Products & Breakage

Some products offered through loamholm.com, including ceramic, porcelain, stoneware, and glass pieces, are inherently breakable and should be handled with reasonable care.

We use reasonable packaging practices for shipment, but customers should take care when unpacking and handling fragile products after delivery.

If a product arrives broken, cracked, chipped, or materially damaged during transportation, please follow the reporting procedures described in our Shipping Policy and Refund & Returns Policy.

Damage occurring after delivery because of accidental dropping, impact, improper storage, misuse, or other customer-caused circumstances is not considered transportation damage.

14. Intellectual Property

Unless otherwise stated, content made available through loamholm.com, including website text, product presentation, graphics, logos, icons, layout, photographs, design elements, and other original materials, is owned by or licensed to LOAMHOLM, LLC and may be protected by applicable intellectual property laws.

You may use the website for personal and lawful shopping purposes.

You may not reproduce, republish, commercially exploit, scrape, distribute, modify, or create unauthorized derivative works from protected website content except where expressly permitted by applicable law or authorized by LOAMHOLM, LLC.

15. Prohibited Conduct

You must not use loamholm.com for fraudulent, deceptive, abusive, unlawful, or unauthorized purposes.

Prohibited conduct includes submitting false payment information, attempting unauthorized transactions, manipulating discount or checkout functions, abusing return or refund procedures, submitting knowingly false damage claims, interfering with website security, introducing malicious code, or using automated systems in a way that places unreasonable strain on our website.

We may restrict website access, suspend accounts, refuse service, cancel orders, or take other reasonable action where we believe these Terms of Service have been materially violated or action is necessary to protect customers, our systems, payment providers, or legitimate business interests.

16. Fraud Prevention, Verification & Chargebacks

Certain orders may be reviewed for suspected fraud, unauthorized payment activity, unusual transaction patterns, inconsistent billing or shipping information, repeated disputed transactions, or other security concerns.

Where reasonably necessary, we may request additional information before fulfilling an order or cooperate with payment providers, banks, card networks, carriers, or lawful authorities when investigating suspicious activity.

If you believe there is a problem involving an order, shipment, refund, or payment, we encourage you to contact LOAMHOLM, LLC before initiating a chargeback whenever reasonably possible so that we have an opportunity to review the issue.

If a payment dispute or chargeback is submitted, we may provide the applicable payment provider, bank, card issuer, or card network with relevant order, payment, shipping, tracking, delivery, return, refund, and customer-communication records.

17. Limitation of Liability

To the fullest extent permitted by applicable law, LOAMHOLM, LLC will not be liable for indirect, incidental, special, consequential, or punitive losses arising solely from use of our website, carrier delays, customs processing, third-party service interruptions, customer misuse of products, inappropriate product care, incorrect customer-provided information, or circumstances beyond our reasonable control.

Nothing in these Terms of Service is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable consumer-protection or other mandatory law.

Nothing in this section removes any rights customers may have in relation to products that arrive defective, materially damaged, incorrectly supplied, or otherwise fail to meet mandatory legal requirements.

18. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, or reasonable expenses arising from your material violation of these Terms of Service, fraudulent activity, unlawful use of our website, infringement of third-party rights, or misuse of products.

This provision does not apply to the extent that a loss results from unlawful conduct, negligence, or another form of liability by LOAMHOLM, LLC that cannot legally be excluded.

Nothing in this section limits mandatory statutory rights available to consumers under applicable law.

19. Governing Law, Disputes & Court Proceedings

These Terms of Service and any dispute arising from or relating to loamholm.com, an order, a payment transaction, a product purchase, or our services will be governed by the laws applicable to LOAMHOLM, LLC, without prejudice to mandatory consumer rights that may apply in the customer's place of residence.

We encourage customers to contact us first where a dispute arises so that the parties have a reasonable opportunity to review the circumstances and attempt to resolve the matter through communication.

If a dispute cannot be resolved through reasonable communication, the dispute shall be submitted to and determined by a court of competent jurisdiction.

Where legally permitted, court proceedings will be brought before the courts having lawful jurisdiction over LOAMHOLM, LLC and the relevant dispute. Nothing in this section removes any mandatory right a consumer may have to bring proceedings in another court where applicable law grants that right.

20. Changes to These Terms & Contact Information

We may update these Terms of Service periodically to reflect changes in our tableware collections, website functions, payment services, shipping arrangements, return procedures, legal requirements, or other business practices.

Updated Terms of Service will be published on loamholm.com. The terms in effect when an order is placed will generally apply to that transaction unless applicable law requires otherwise.

These Terms should be read together with our Shipping Policy, Refund & Returns Policy, Payment Policy, and Privacy Policy.
